If A Child Is Born On An Airplane,What’s His Place Of Birth And Citizenship?


A woman gave birth to a child on board a British Airways jet flying from London to Boston. The pilot received permission to land in Nova Scotia when it became clear there was a delivery in progress, but the baby was born before the plane could land. As far as what goes on this child’s birth certificate next to “Place of Birth” and of what country this child can claim citizenship, it all depends on who you ask. In this case, we’ve got a mother described by the British Airways crew as Egyptian and traveling on a U.S. passport, and a plane that took off in Britain bound for the United States that landed in Canada. So where is this child from?



Almost every country in the world, as well as the United Nations, has procedures and recommendations for how to properly classify the geographic details of an in-air birth. The United Nations considers a child born in-flight to have been born in the airplane’s registered country. Some countries point to the city where the child first disembarked the plane as the place of birth, and to the airplane’s registered country as the place of citizenship. Of course, citizenship and birthplace are two different topics — citizenship is typically a larger issue and may require some paperwork, while writing a child’s birthplace on a birth certificate is often a less legally significant  consideration

    IMO, it's left for the mother(and father) to decide which citizenship they want their child to take.

    Right now the parents have has 3 citizenship to choose:
    *British-departure point
    *American- destination point & mother's citizenship
    *Canadian-arrival point

    Since the child was delivered while air bound, it is only reasonable to use the immediate country where the plane lands as place of birth. Very tricky situation though

  7. citizenship is solely within the power of a country to give. for example if America wants she can consider a baby born so many feet above the sea level as her citizen. she can also deny citizenship to a baby legitimately born on American soil. that is why Britain does not give citizenship merely by being born in British land.

    it is purely domestic and thus cannot he regulated by international law.

    back to your question, the country where the airplane landed might decide to accept the child as a citizen. if not the child would take take up his or her parents citizenship.

  8. The baby is canadian, if the plane landed in canada even though the baby was already born in the plane. The baby would be taken to a hospital in canada, processed for social security,birth certificate and things, but the mom being a US citizen will or can still file for the child which will give the child dual citizenship..

  10. Normally it's the airplane's registered country that will claim citizenship,hence Britain....place of birth could be canada.

  11. E no matter jare. The mother has a uS passport. All she needs is a Borth certificate to get the baby/her child a US passport (doesn't matter where she born am)

    And we all know american pali = citizen of the world.

  13. The pilot can help with that place of birth Info if it's that necessary and if he wants to!
    In that,as at the exact time of birth,when he was told a woman has birthed on his plane,which location was the plane?thats d child's place of birth!
    Eg one is enroute lagos to abj by road,and a child is born at lokoja entrance,the place of birth is lokoja,kogi state.and so should be with the plane birth too!

  16. A child's place of birth and citizenship have far reaching implication. Eg, how u acquire ur US citizenship affects ur qualification to run for political office. So, in such climes such matters are treated with extreme caution. For, the planes destination or first port of call should be the child's citizenship

  18. The place of birth is Canada. But the child might be able to also claim British citizen since it was a UK reg BA aircraft. And also derive US citizenship from its mother.
