Biola is the younger sibling of Dr Suraj Giwa, who was killed on February 26, 2005, in an auto-crash caused by jailed actress, Ibinabo Fiberesi­ma
Biola,who says she has moved on,granted Nonye of Punch an extensive interview where she said Ibinabo lied and that she is suffering today because of the way she conducted herself after the accident......




  • Were you in Nigeria when your brother, Dr. Giwa died?

I have always lived in the US. I was home when the accident happened. I have been living in the US
for the past 33 years. We have forgiven Ibinabo. We have moved on with our lives. My mum is still alive.  She cannot talk to anybody on this issue. It is going to be a fresh wound. Some people are saying we have not forgiven her. But that is not true. The Giwa family has moved on. It was an accident and accidents do happen.  When people go out every day, I don’t think anybody sets his or her mind to go out and kill somebody.

  • So why is Ibinabo’s own different?

It wouldn’t have been like this. It was just the way she conducted herself after the accident.  When the accident happened, she fled the scene of the accident. She doesn’t have good advisers. The state government had to find out who the owner of the car she was driving was. That was when it was found out that the car belonged to Daniel Wilson.



  • Didn’t you know who Ibinabo was then?

My first time of hearing that name was the day of the accident. I had been in the US for over 20 years then and there was no way I would have known anything about her then.  I had another brother who was also in the car when that accident happened. You can imagine two people of the same mother and father in that car. They didn’t try to help them out, they all ran and left the scene of the accident.

  • But some eyewitnesses said Ibinabo didn’t flee but was rushed to the hospital…

If some other people were in the car with her, what about those people? How come they didn’t try to help? Somebody should have stayed at that scene to say he or she was with Ibinabo. But nobody said anything. And how come the eyewitness is coming out now to talk? Where was he all these years? I read he said my brother was shouting, ‘I am a doctor, don’t hold me like that.’ But that is a lie. Have they forgotten that there were other occupants in the car?

  • Did you meet your brother alive when you got to the scene?

No. The other car was right on top of his car. The other occupants were able to crawl out.

  • We learnt you said you would never forgive Ibinabo and you would make sure she was sent to jail…

Why would I want to say that?  Is it not God that forgives? I don’t even know her, so why would I say I wasn’t going to forgive her? I didn’t know who she was. We weren’t even bothered about her. My mother had two kids in that car. My brother’s wife came from England and we were having a prayer session. That was when I saw Ibinabo. Would I say anything like that during a prayer session? We were all crying. One of them went to my husband and somehow, it was arranged that they meet me. My other brother who was involved in the accident works in the US and he had to go back. He asked me to stay for a little while so that one of us would be with our mother. I had to stay.

  • But did you at any point have a one on one discussion with her?

God is my witness, my husband was also there, she got out of the car and she came to me. The people she came with were just somewhere there, they didn’t even come close. I asked her what she wanted and she said she had come to plead so that the charges would be dropped. I told her it wasn’t between us and her but between the state government and her. But I told her I would rather give her an advice that would work for her. I told her if I were in her shoes, I would apologise publicly to the masses and also to the family. I advised her to throw herself to the mercy of the court. If she had done that, people would know she was remorseful and they would know she had indeed apologised. But she said she wasn’t going to do that. She said it would damage her career.

Believe me, if not that so many eyes were on us, I would have kicked her for saying that. My husband was beside me when she said that. He even looked at me. I couldn’t believe it. What? Dr. Giwa was the head of physical rehabilitation medicine in LASUTH. He was the only one that had that credential then in Lagos State. Dr. Giwa was valuable to the state. He had helped a lot of people out. We have forgiven her; my mother has moved on, Dr. Giwa’s kids have moved on.

  • Weren’t you offered money as a form of compensation?

What money? We don’t need her money! We are all good! Dr. Giwa wasn’t the only breadwinner. Every one of us is doing very well.

  • But we learnt you threatened to kill her…

I learnt they said I said I would go and kill her. But why would I do that? I hadn’t ever heard of her name before then. I had never seen her before. If I had wanted to kill her, I would have killed a lot of people since I didn’t know the identity of the person I wanted to kill. I wasn’t going to do anything to her.


  • Was it that what you needed from Ibinabo was public apology because we learnt she kept apologising to the family and nobody wanted to listen to her…

Did she apologise publicly? I just wanted her to apologise publicly so that people would know she was remorseful. But I don’t think it was a wrong advice I gave her. She couldn’t apologise publicly back then but now, she wants Nigerians to pray for her. But I say it again; it is not me versus Ibinabo. It is not Giwa’s family versus Ibinabo. I am married and I am still with my husband with three wonderful children. My kids are all grown. What do I need from her? We are not in the same age group. I am older than her for God’s sake. I am in my 50s and I am the youngest of my mother’s kids. I am even good because if you talk to my other sisters, they would be ranting. She couldn’t apologise publicly because she put her career ahead of her.


  • But Ibinabo reportedly said she had been visiting your family in Nigeria here but she was warned not to come close again…


But that is a lie! How could she say that? My mother is in Lagos. Ibinabo has never visited my mother! My mother does not even remember her name. She doesn’t know if Ibinabo is white or black. Why would we warn her from visiting my mother? I read that story in the papers and I had to ask myself what is wrong with her. If she truly said that, then she lied. She doesn’t have good advisers, I must tell you that again.

  • Some people said you are jealous of her…

How can I be jealous of Ibinabo? I am married and I have three wonderful kids with the same man. I am very successful. I am an accountant. It can be annoying when you hear some things. We had the memorial service for my brother some weeks ago…

  • Was it before the judgement?

Oh yes! The case had dragged on for so long. The magistrate court had found Ibinabo guilty. The DPP department took over the case; we weren’t the ones that took her to court. It has never been us. They found her guilty and sentenced her to prison for five years with an option of N100, 000 fine. So who wouldn’t look for N100, 000 to pay? Are you saying the life of the doctor was worth just N100, 000? The state went to high court and the high court found her guilty and said the N100, 000 should be returned to Ibinabo. The court said there shouldn’t have been an option of fine. Ibinabo went to appeal. It is all about her ego. The appeal court dragged on so long. Believe me, I never knew the case was still on.


  • Are you saying you people weren’t following the case all along?


No. People just told me about this judgement last Friday. Some people called me from Nigeria and I was even amazed that the case was still on. I have already moved on with my life. I do come to Nigeria and I spend some time but it has never been because of this case.


  • What if she eventually apologises publicly?


I keep saying this; it is not between us and her. I don’t have anything to say on this case. It doesn’t matter to me now if she does or not. If she does it now and the government decides she has been remorseful and pardons her, so be it. I don’t know who the judge is, I don’t know if he is a man or woman. I don’t even know who is handling the case. If she apologises now, it wouldn’t have anything to do with me. It is a broken wound. I only gave her advice then and she didn’t take it. I can’t even recognise most of these actors and actresses in Nigeria. I hardly watch Nigerian movies; I don’t have the time because I am very busy.

  • We learnt you were excited about the judgement…


No. I wasn’t when I heard it. I was not excited and I was not sorrowful either. I just said we needed to thank the justice system because the case was delayed for so long. If we don’t thank them, they will not put people to order, they would think they could do anything and get away with it. Accidents happen and that is why it is called accident. But your attitude towards it is what matters most. Some people have accidents less than this and you would see how remorseful they would be.


  • But couldn’t the Giwa’s family have asked the state to drop the case?


No. It is not done that way. It is not done like that in the US where we live. I wouldn’t know if it is done like that in Nigeria. You don’t even tamper with the judicial system. If you are taken to court, then you are taken to court. Justice is in the hand of God.


  • How did your mother take his death?


It wasn’t easy. She didn’t have High Blood Pressure before but she developed it after that incident. We had to rally around her. But she also believed God has given and God has taken. She was able to manage and we helped her.


  • Don’t you think Ibinabo has suffered enough? She was in jail at some point…


She was in jail for about three weeks and she was bailed out. Nobody is above the law. I always behave myself. I always pray to God that I don’t get involved in any kind of accident. I always beg God not to take me through accident. I don’t want to hit anybody and I don’t want anybody to hit me. I can’t go to the government and ask them to drop the case.


  • Are you still in touch with the doctor’s family?
Of course, they are my family. One just came here. We communicate all the time. We travel to the UK to see them too.

From my own perspective, the lady asked ibinabo to apologize publicly to attract sympathy and subsequently get a reduced or no sentence at all. Superficial minded people with no substance would allege envy from a well established and successful accountant in the U.S! OJ Simpson is in prison today cos there's nobody against the law and a testimony that there's no rest for the wicked. Ibinabo is a Nigerian citizen bound by the laws in Nigeria. She has been found guilty in a competent court of law based on the evidence before the court and duely sentenced. Our justice system may not have gotten it right in the past, but in this case, I believe the did. No one is above the law absolutely no one.

    6. The public apology was for the benefit of the court and a gesture that would have attracted some form of leniency on her case. Her apology to the family had no bearing on the case at all. She was in double jeopardy with the court- having that accident AND fleeing the scene. Obviously, Ibinabo didn't want to admit that in public cow of her career.

      Do you know that when jailed people are due for parole, they are brought before a panel and asked to justify why they should be released from prison? Their attitude, body language and utterances will determine an approval or otherwise. This lady partied HARD and she was in the eye of the public 24/7 while the prosecution team watched and took notes.

      The lady gave her good advice, she should have taken it. My brother was poisoned by our cook years ago. If I see the cook today, I would probably let him go but a court would jail him for murder. It's the system, this is how it works. The fact that jailbird is a celeb, we're crying foul.

      Nobody is above the law. Celebs go to jail all the time- Lauren Hill, Wesley Snipes, OJ....

It is the last opportunity for the convict to show remorse and plead for leniency. Some are so compelling that the court will be moved and magnanimous enough to slice off an appreciative amount of years off the initial prison term.

      I've witnessed a particular proceeding ‎where the allocutus by the convict was so emotional that the judge had to rise and go into his chambers to comport himself because half of the people at gallery and even counsel at the bar were in tears. When the court sat a few minutes later, the judge said he had already decided the sentence to pass but he was moved to allow justice wear a human face and the punishment was so watered down that we didn't even know how to react, we ended up being stunned!

       The accused was convicted of breaking and entering a dwelling house which carries a maximum sentence of 14 years imprisonment. ‎Though the accused was granted bail, the terms were so stringent that the accused could not perfect the bail terms so he remained in prison custody throughout the duration of the trial which dragged on for over 4years. The judge sentenced him to 40 months imprisonment and declared the sentence already served!!! Though the stigma of being an ex-convict‎ will be with him for life, he walked out of the court that day a "free" man.

      Moral of the story, never underestimate the power of remorse. Repentance goes a long way and can even commute a death sentence to a way lesser sentence.‎

When you drink it's not a problem but when you are drunk allow another person take the wheels or simply be in the cab.. You have no business driving when drunk. This is my issue with the case.       We have seen many cases of accidents and nothing to happened to the driver after he begs the family. But in a case where it's hit and run and then prove you were drunk, it's stated in the law for such person to be convicted..

    The issue is her conduct AFTER the accident!
    In criminal cases, you can't tell the family of the victim to take their hands off the case as it's now between Ibinabo and the State! The family has no say in this. This isn't a civil matter please.
    The only thing she should have done was to conduct herself in a manner that would show the court, the family and the general public that she was indeed remorseful about the incident. The court could decide to take that into cognisance while delivering the judgement but the court isn't bound to.
    A life was lost, a man killed! Don't act like that doesn't matter. Some comments here just churn the stomach. Imagine typing crap like 'You're jealous Ibinabo is more beautiful than you are, go and drink sniper and join your brother'

    2. As a matter of fact, im 'saying' what I do know.
      Once the matter has been brought before the court and is now between the state and the accused person. The advice given to Ibinabo would have been to her advantage if she had taken it. She would have shown the court that she was remorseful and that could have been considered by the court while delivering judgement. Also bear in mind that this is a case of manslaughter.
      The first thing to do was NOT to flee the crime scene and if she was indeed carried away for her safety as alleged, she should have submitted herself to the nearest police station as soon as possible. Instead she waited for the police to investigate and find out that she was the driver.
      So please don't teach me what I already know, thanks.

I think the law was even lenient on Ibinabo, she commited manslaughter so she needs to serve her term even if she has apologised publicly she still commited manslaughter and a court of competent juridistion will sentence her accordingly. 5 years is even fair each time I go to prisons for evangelism I leave there crying. Go to kirikiri and see people who stole less than 10k awaiting trial for more than 10 years. Ibinabo will retrace her steps while in prison and I believe she will come out stronger.   54. To get a better perspective on this issue, we need to replace the characters with alphabets. Say X is a lady who accidentally hit and killed Y, the late doctor and the sister who gave the interview is Z. Whether we admit or not, the celebrity factor taints objectivity. Some of you are her fans, some are not. Personally, she seems like a pleasant lady so it will be hard not to empathetic to her plight but we must remember that a soul was lost and family members are still grieving in their own way.

    True, 100 years of imprisonment will never bring the late doctor back but loss is something one never gets over, you only learn to live with the pain. It's easy for us to pass judgment from the comfort of our homes with our loved ones very much around but can we for a second imagine if, God forbid, it were our husbands, brothers, fathers, uncles, even best friends. Will we be so rational? Of course not, grief heightens the senses and sends objectivity through the window. Then imagine if we hear that the person responsible for the death seems to be getting special treatments because of their celebrity status? Oh! Naturally we will be furious and our anger will be through the roof.

    Like they say, what happens is not as monumental as our reaction to it. Even the Bible says a soft answer turneth away wrath. It appears I.B didn't show enough remorse or her remorse was perceived as corrupted with arrogance. If we are to believe the sister, saying you can't make a public apology because of the negative effect on your career, to the family of the bereaved is worst than a dagger to the heart. Some of you are spit fire, you get so enraged at an innocent comment a BV makes which isn't even directed at you so imagine if someone who caused the death of a family member says that to your face? Some of you guys will reenact the crucifixion.‎

    Nothing can bring back the dead but attitude and reaction goes a long way. Even when a patient dies due to medical error, does the reaction of the doctor(s) in charge not help deal with the pain? Will it be ok for the doctor(s) responsible to throw one of those annoying one-liners like "take heart, we did our best" or "God giveth and God taketh away"‎? Will you be rational enough to say "well, he is dead so no amount of apology will bring him back, doc, I forgive you"?

    It's very easy to dissociate ourselves from both sides because no matter how hard we try, we can never feel the pain of both the bereaved and Ibinabo. We seem to forget the main issue here is the wrong judgment of the magistrate who awarded a fine for an offence which carries a compulsory prison sentence, even if the maximum sentence wasn't imposed. This saga got more sensational because a Court of appeal upheld the decision of the High Court to imprison the accused, thereby opening old wounds. If the magistrate did the right thing, she would have served her sentence and been a free lady now because what seems to aggravate most people is the fact that it happened over a decade ago so it's water under the bridge.‎ But there are two families  that will never be the same again, quite unfortunate.

  57. The press should stop the interview with this wicked family. Had the accident happened last year, I would have said passion was still hot and thus their bitterness. Since it is over ten years and they cannot forgive, let them carry their wickedness out of our sight. Ibinabo is already in jail, what else do they want?

I am so shocked at the comments of some Bvs, pls use ur Google and check cases in other countries when a case becomes a state case, there is nothing anyone can do, not even the Giwa's family could have done anything. The case was between IB and lagos state not Giwa n IB. It is only in Nigeria that we use sentiment and declare witchute cos a celebrity is involved!! The truth of the matter is IB Didn't do well, all the guys saying rubbish were not there when the incident happened neither when she alleged she went to apologise to the family. Two years ago there was an accident on third mainland bridge in the night, a man had a flat tyre, came down to change it and was about putting the bad tyre in the car when a fast moving car knocked him down and killed him immediately, the man could have driven off but he stopped and still rushed the dead man to the hospital, reported himself to the police and kept going to the man's family. The dead man wife been a born again Christian told the man she forgives him, even when the extended family wanted to pursue the case further, the dead man's wife refused and kept saying the man could have driven off but he didn't and went the extra mile. It is ur attitude when an incidents happens that matters and like someone rightly said when it happens to you then u will know how it feels! The recent case of the Sunderland footballer should also give an insight that when it comes to the law none is above except in nigeria and that's why u bunch of idiots that don't know the law are saying the family should have told the court to let IB go!! IB was the one appealing the case not the family! The law has to take it cause, if I was the Giwa's family I won't even grant an interview again and just keep quite, whatever anyone think is thier cup of headache, when u find urself in the same situation then do as u deem fit.

  66. I dont think that she is pettty rather I think the interviewer made her very defensive with the questions. The interviewer kept asking questions that belittles the incident and the family's emotions and reactions to it. I believe that what happened in this case was...,1. Manslaughter is a criminal case and not civil. The family had little or no influence on it,maybe at the initial stage but the wound was still too fresh for them to be considerate of Ibinabo 2. The public appeal advice by the sister was a good one because Nigerians being an emotional set of people would have empathized with her but her refusal to do that with the excuse of being protective of her carrier over a man's life was shallow and I'm sure any family would feel slighted by that singular act! The family being educated, connected et al must have felt the need to relent the reins to the state while pushing for justice. Naturally, when someone hurts you and acts like you can't do nothing about it, you'd likely move heaven and earth to avenge your hurts but genuine repentance helps us forgive and also aid the healing process. I pray that God comforts the family and give them a heart of forgiveness because holding on the unforgiveness is unhealthy and is a big sin itself. As for Ibinabo, justice had its way in this case but I pray she finds mercy with God and for grace to speak for her.

  67. I have gone through all the comments above and I want to simply state that I blame ibinabo's lawyers in this case. Particularly at the magistrate court level. Being a lawyer myself, I have been involved in similar situation and I think the lawyers are to blame.

    First and foremost, to think or to assume that this case is between the govt and ibinabo without the input of the family is balderdash. Think about this who supplied the witnesses for the government. Certainly the prosecutors would have worked with the family to provide witnesses. That is where the lawyers erred. They should have from the word go inundate the family with remorse so that the government would have found it futile to pursue the case. This they could have done by constantly appealing to the family, buy them off if possible.
    The only defense in this case is that it happened by accident and if they had succeeded in proving that ibinabo will still be given some form of punishment. So, apologising in the public would have helped the case rather than destroy it for the defence.

    My legal analysis is that ibinabo got text book lawyers and not practical lawyers. This case should never have gone to trial because it will end up the way it has.

    No need to go to supreme Court,because that court will certainly uphold the judgment of the Appeal court.

    Ibinabo, simply do your time and forget it. Your lawyers messed up big time.

    One more piece of advice to the lawyers, try challenging the sentence only at the supreme court, leave out the facts that are not relevant. Good luck to all.
