Ibinabo’s Fiberesima's 5-Year Jail Term Upheld By The Appeal Court

The Court of Appeal in Lagos today dismissed an appeal by Nollywood actress Ibinabo Fiberesima challenging a jail term slammed on her by a Lagos High Court. Ibinabo was sentenced to five years imprisonment by Justice Deborah Oluwayemi of a Lagos High Court for reckless driving which resulted in the death of a hospital staff.




 She was alleged to have driven her car recklessly on the Lekki-Epe Expressway and knocked down a man, Giwa Suraj. The deceased was said to be a staff of a Lagos state’s hospital. A Magistrate court (court of first instance) had earlier given the appellant an option of N100,000 fine for the offence. 


The judgment of the magistrate was,however, set aside by the high court which replaced the option of fine with a jail term. Dissatisfied, Fiberesima had filed an appeal through her lawyer, Mr Nnaemeka Amaechina, urging the court to set aside the five-year sentence. Delivering judgment on Friday, the appellate court dismissed Fiberisima’s appeal and affirmed the decision of the Lagos High Court.


 In a unanimous decision delivered by Justice Jamilu Yammama Tukur, the court held that the trial Magistrate Court lacked the discretion to have granted Ibinabo an option of fine having been convicted. The court further held that the appeal lacked merit and consequently dismissed it. Other members of the panel are Justice U.I. Ndukwe-Anyanwu (presiding) and Justice Tijani Abubakar. 


It will be recalled that the appellate court had earlier ordered the appellant to appear before it when judgement was to be delivered. Counsel to the appellant, Amaechina, said the judgment will be challenged at the Supreme Court, adding that a notice of appeal had already been filed. Justice Oluwayemi of the trial court had held that the magistrate exercised “judicial recklessness” when he gave the convict an option of fine. 


The court noted that the trial Magistrate must have misdirected himself based on the allocutus made by the counsel to the convict that she is a working mother. Oluwayemi had held that Sections 28 of the Traffic Law under which the accused was convicted did not give an option of fine. She held that “when a term of imprisonment is mandatory for an offence the court cannot and should not give an option of fine.” She insisted that the fine did not serve the purpose of justice in the case and subsequently ordered that the N100, 000 be returned to the appellant.

      Let me help you break it down ibinabo was given an option to pay a fine of 100k by a magistrate and she paid that fine but the judgement was cancelled by the high court because the magistrate court first of all does not have the jurisdiction (authority) to handle a manslaughter case and secondly giving an option of a fine was improper because the traffic law did not give an option of a fine for such an offence. Subsequently, the high court sentenced her to 5 years in prison for her offence. Then the appeal court upheld the decision of the high court ( the 5year prison sentence) and ordered that the 100k be returned to Ibinabo.
      If you still can't understand this then you are probably hopeless.

    My sister was disfigured in an accident caused by a drunk driver. She is still not married today. We did not report the driver to the police, not to talk of prosecuting him. Forgiveness can heal a lot of wound. A lot is on the pipeline for her. That forgiveness has brought a lot of goodness to her. One day,I will bring her story here.

  40. All this sentimental rantings is for nothing. The #1 victim of the accident is DEAD. Whether 5yrs or 50 yrs will not bring him back to life. It's okay for Ibinabo to serve jail term for manslaughter. It will give her closure of this whole saga & somewhat settle her conscience too. It might not have been easy with her and her own conscience. That is regardless of the legal drama and hurdles she's been trying to overcome. That one sef even small pass how her mind go dey worry am.

    I pray the deceased family too will have some peace, that justice prevailed.

    Anyway or anyhow you look at it, tragedy, waste of life, mishap, unfortunate, sadness is all you see. The man's kids are fatherless, Ibinabo's kids too will be motherless temporarily, so make she just serve the time, so this too will rest.

    Nevertheless some of us are strong putting up façade of "all is well". I guess most of you wanted her to be crying on Social media about this tragedy. She knew she was jail bound, she came out of the AMCVA putting up that façade. How una want make she do?

  55. Queen of whatever you are an animal. Pay off the family Abi, if someone kills your own family member while drunk you can choose to collect money since you are a hungry mofo. That poverty has been allowing people get away with stuff does not make it the norm. This is not GEJ's government when anything goes. Now you commit a crime you do the time. When people go to jail for rape or murder it does not reverse the crime but act as a deterrent for others .
