Lawyers Volunteer To Participate In Trial Of Erring Judges

THE League of Patriotic Lawyers has said it would participate in the trial of alleged corrupt judges, noting that there was no law that stopped any relevant law enforcement agency from arresting suspected erring judges.




It also demanded a quick, fair and transparent trial, adding that judges could be sanctioned where there is a manifest breach of their sacred duties.
Briefing newsmen, yesterday, in Lagos, President of the League, Mallam Abubakar Yesufu argued that some sections of the Administration of Criminal Justice Act, 2015 gave strength to the Department of State Service, DSS, to execute a warrant anytime.

His words: ‘’The League of Patriotic Lawyers has called for caution in the ongoing face-off between the Department of State Service and the Judges. The war on corruption must be fought and has always been fought within the limits of the law. Judges are not above the law and could be sanctioned where there is a manifest breach of their sacred duties.

“The cesspool of corruption that has bedevilled the hallowed chambers of justice needs a surgical operation to redeem if that arm of government is to be taken seriously. Without trying to prejudice the trial, the league is throwing its weight behind the security agency. The arrest is bold and courageous. The League admonishes them to ensure a quick, fair and transparent trial.”

‘’The league promises to participate in the trial and admonishes that the innocent must be set free and the guilty punished without fear of favour. On the method and time of arrest, the combined effects of Section 121 – 4 and Section 148 of the Administration of Criminal Justice Act 2015 gives strength to the agency to execute a warrant anytime.”

  7. If this judges are guilty @ the end of the trial then am sorry for my noble profession. What were they thinking, when millions of young lawyers look up to them,I remembered when I went to sign my benchers form for call to bar and I appear before juctice Ngwuta.It felt heavenly cos I never imagined them to be corrupted cos they judge corrupted and criminal minded people, little did I know that I was on a long thing. Until they are proven guilty,I rest my case but I fear for my dear country.

  9. No one is against the war on erring judges. What intelligent Nigerians are saying is, DSS raiding those Judges houses is unconstitutional and they acted outside its mandate. Before we take a look at their roles and functions, let us take a quick look at the history of DSS. The Department of Security Service was first known as SSS and was established in 1986. According to the decree, the DSS(originally known as SSS) are responsible for intelligence within Nigeria, they are also obligated to investigate several threats to the nation like espionage, subversion, sabotage, terrorism and related crimes against the state.

    EFCC and ICPC are most empowered under Nigerian law to investigate and try corrupt practices. Moreover, there is a disciplinary body for erring judges which is NJC. They should have written to NJC to report those judges so an investigation can take place and wait patiently until NJC completes their investigation. We are saying is, follow the due process. Follow the rule of law while nabbing corrupt judges, lawyers and even the commoner.

    These Patriotic group of bribed lawyers feeding directly from the Presidency must really think we are dumb. They are bunch of sell-outs who would do anything for money. I am sure they would be floored in court.

    Once something is unconstitutional, it becomes null and void. Let us not also forget, in Nigeria, the law states we are innocent, until proven guilty. This is not a war against corruption, this is distraction tactics. Say whatever you have to say, this is tilting towards witch hunting too.

    What DSS did is same as FRSC obtaining warrant from any flawed magistrate court, to raid houses and accuse people of corruption. Is it within their mandate?

    We, Nigerians have to start thinking straight and avoid unnecessary sentiments. Rules are there for a purpose. This is not an animal kingdom. Intimidation against the judiciary in any form will not succeed. Although, I know this case will not fly because the presidency is playing with fire, however, I am more concerned about the damage done to their reputation.
