One of the key proposals is the Preventing Abusive Digital Replicas Act, which seeks to amend the Trademark Act to stop the use of AI‑generated likenesses in ads and online content without permission. The bill notes that deepfakes are already causing reputational and emotional harm.
California has also stepped in with SB 1050, a law that forces advertisers to clearly disclose when they use AI‑generated performers. The aim is to protect creative workers and prevent consumers from being misled.
Another major effort is the bipartisan NO FAKES Act, which has advanced in the Senate. It would make it illegal to create or distribute digital replicas of someone’s voice or image without consent, and it holds platforms accountable if they host such content knowingly.
A strengthened version of the bill introduced in 2026 expands protections and creates clearer rights over a person’s likeness, as lawmakers warn that deepfake misuse is rising across entertainment, politics, advertising and online scams.
Together, these bills aim to set strict boundaries around AI‑generated content and ensure people can control how their identity is used.
