  4. As horrible as the story sounds, I doubt if there can be any conviction on this.

First of all, the EFCC was created to handle financial crimes and economic sabotage. This does not fall within the purview of the EFCC's jurisdiction, but rather NAPTIP.

Secondly, the offence of trafficking arises only when one party uses force, fraud or coercion to compel the victim to perform commercial sex or causes a child to engage in commercial sexual activities.
If the alleged victims are not children, and there is no element of fraud or force found, then the charges cannot stand.

Assuming the parties are willing adults, it is only an issue of morality, not law. I will love to see how this plays out in court.

    4. You think or you know?

The basic criminal statutes in Nigeria are the Criminal Code (for Southern Nigeria) and the Penal Code (for Northern Nigeria). You think or you know that no section in either statute covers the act alleged against the woman?

If one criminal enforcement agency lacks jurisdiction over a crime, it can hand the suspect over to the appropriate agency after preliminary investigation, right?

    5. Nocturnal, she referred you to the EFCC Act, you haven’t read it and you are here saying you don’t think. Read the Act first to know if the crime isn’t covered there

    6. Anon 16:24, you're correct as regards handing over a suspect to the appropriate agency that has authority to prosecute. I just wonder why the EFCC was involved in the first place.

As Dante and Teejay pointed out, if EFCC wants to prosecute the matter, they may just find a way to change it to money laundering. However I don't know how they will be able to prove it.

Anon 19:05, I have read the EFCC Act. There is nothing there that relates to combating sexual offences. It is purely for financial crimes and other acts of economic sabotage.

I think the girl may have stepped on someone's toes, and the person wants to teach her a lesson. It might be a wife who found out that her husband belongs to such group. Or probably a man who paid for services and she refused to come and visit him. In that case, the prosecutors may find a way to bring in a criminal element to the matter.

But like I said earlier, if they are all consenting adults, this case will be a difficult task.

  5. Wow
    Body of Christ don suffer..
Pimping is not sex trafficking oh..
Lady does this with their knowledge, out of greed, but sex trafficking, the victims are not aware... They lie to them, promise them work, some are even trafficked by their boyfriend,it's like a sex slave.
So please educate me more how both are related..
