Doctor Freaks Journal - "Backyard" Surrogacy

This story is a must read!!!







A few years ago, I received a distress call from a friend. He had just been informed that his domestic staff together with his wife (the latter's) who had earlier kidnapped "his" son had been apprehended, so we needed to move fast! He was ready to spend his last penny just to ensure that these "kidnappers" go to jail. 

Hmmm...


I dashed down to his apartment for proper briefing. He is well-to-do. He has an array of domestic staff ranging from a gateman to a steward and a house keeper. Of particular interest is the steward.


 The steward left his wife and children at his brother's place and moved in with my friend but at some point, out of his magnanimity, my friend encouraged the poor guy to bring in his young family to live with him since my friend had a very big apartment and he was actually living alone. 


The lad jumped at the offer and brought in his beautiful family. The steward was less than 30 years old at the time but he had sired 4 beautiful children and I later discovered that his young wife was a beauty to behold. 

We shall come back to this point later.


Back to my very dear friend's story. He is wealthy. He was married but for personal reasons the marriage was dissolved and he resolved not to remarry but he wanted more children. He was so nice to the steward to the extent that he showered him and his family with all sort of gifts and he even made several trips to Mr Steward's place of origin on several occasions. 


My friend is from a privileged background but he humbled himself to the extent that he slept in the steward's father's hut each time he accompanied him to the village outside Nigeria. They became "family" and one thing led to the other.


There are two sides of a coin and the natural principle of justice enjoins all to listen to both sides.

It was the case of my friend that the steward observed that he was sliding into depression and upon several interrogations from the steward, he opened up to him that he was lonely and would love to have more children that he could call his own since the court had granted the first wife full custody of his first set of children. 


It is also his case that the steward made him an offer. Hmmm... The steward offered him his wife to give him two children, allegedly. There was no written agreement but there were bank slips, receipts of hospital payments, purchase of baby stuff, etc. My friend "knew" his steward's wife and she sent word to my friend that "I'm with child."


 From the moment her pregnancy was confirmed, my friend moved madam into the main building and started "taking care" of his surrogate "wife". Nine months after, we heard the voice of the mother and that of the child and my friend continued to care for mother and child and the stepfather. 

Six months after, the steward and the wife connived to flee. They fled with my friend's "son" and he went berserk! Poor dad.

 He left no stone unturned. The law enforcement agencies launched a manhunt and they were in luck. They succeeded in apprehending the fleeing couple and bringing them back to the country.

Now, let us consider the case of Mr Steward. It was his case that the child in question was his and that at no time whatsoever did the boss have carnal knowledge of his wife.


 He further stated that all the funds transferred into his account were willingly given to him when the going was good. He added that from the moment his boss sighted his wife and her big "yansh," he swore to have a bite and that he even offered him money but he turned down the offer. 


Also, he stated that on several occasions, his boss brought up the idea of having carnal knowledge of his wife but that he blatantly refused on the ground that it was against his culture and tradition, and that it was when he became apparent that he was not going to bulge that his boss started nursing plans of harming them and that he was left with no other option than to run for his dear life. Hmmm...


It was a tough case. The law enforcement agencies that were involved at the time confessed that it was a tough one too.


Queries:
Assuming arguendo that Mr Steward voluntarily gifted his wife to my friend, would that actually qualify as surrogacy under any law?


Mr Steward stated that the over N3miillion that passed through his account within a period of 6 months was freely given even though his monthly salary was N50k. Considering the fact that his salary for the period was N300k, the remainder- N2.7million must have been for Mr Biggs and Işi-ewu then.


Currently, I doubt if there is any legal regime that is regulating surrogacy in Nigeria but I'm aware that some fertility centres are already doing exploits in that regard and I want to believe that their legal departments must have been putting up some contracts, or else, "OYO" is the case of so many people who have subscribed to their services already.


I'm sure you would love to know how the matter ended right? 


At some stage, I withdrew my services on personal grounds. However, before I withdrew my services, it was ordered by a competent court that the boy be sent to an orphanage pending the time he would be ripe for a DNA test. My friend? He was not happy with me because he felt as a lawyer I should have just walked out of the law enforcement agencies and the court with "his" son and that the whole world ought to know that the boy was his son and that there was no need for all the drama.


 I wished him well and moved on.

    1. Please read up on surrogacy and stop jumping into conclusions.

      In the case of surrogacy, the carrier is just a carrier, nothing ties the baby and carrier iologically.

A carrier is one who stands to be implanted with the embryo after all the necessary conditions have been met by her body. But her the womanwas actually impregnated by the Man. Take it or leave it, the emotional attachment will be there.

  7. His woe started when he started listing after his steward wife. The numerous trips to steward's country and sleeping in the hut, all the gift and benevolence was because of the steward's wife "big nyash". This scenario has played out a lot of times. I'm very sure that it's on ground of adultery that the first marriage was dissolved and custody granted to the wife. Rules in adultery for a man- stay away from your wife's friends, her siblings, her relatives and stay far away from the domestic helps too. Your friend was well played.

  8. Ah ah...whrn will the baby be ripe for dna. DNA can be done at any age na...they just need to swab the babys cheek with a cotton bud to get a sample!

    1. It actually happened during the COVID-19 induced lockdown when the courts were not sitting and the law enforcement agencies needed a court order before embarking on that process, so it wasn't ripe actually.

If he wanted a local babe, he could not go to the village and get one beauty but prefers to make such a deal with another man's wife knowing they are poor. He should just carry his kettle abeg.

    I just recently got to know about a case, where a surrogate carried pregnancy and ran away, gave birth where she ran to and started demanding for 6 million before returning the babies. If not for contract, the fertility hospital fought hard with all direct evidence, no illegal anything till those babies were returned back to the rightful owner. She said she was desperate and needed more money, knowing they could afford it. You see contract? Never joke with it please . Have a lawyer friend, that can help draft those things for you at no much price. Everyone should have a lawyer friend. Contract can save you a lot of stress

  12. It is safe to say the baby belongs to Mr Stewart who is legally married to Mrs bigback. The guy should hide himself in shame, he always wanted to fuck the woman and Mr Steward's greed gave him what he wanted. This is not surrogacy, 8t is no where near surrogacy. Under the law a parent cannot be tried for kidnapping his child. It is not even kidnapping. Mrs bigback is the biological mother of the child. It is possible the two men were having sex with the woman. I recall the idiotic married woman that wanted to have kids for my cousin. She had 4 kids for her husband ( 3 girls and a boy). How can a married woman deliberately want to have at least 2 kids with a married man. Funnily my cousin was encouraging her. Disgusting humans .

  13. This is an illegal and an unenforceable contract. Your friend is lucky that the case of Aoko v Fagbemi has nullified adultery as a crime in southern Nigeria otherwise he would be looking at serving jail time.

    Surrogacy however is an evolving practice in Nigeria. I am not aware of any decided authority where a party is held bound to deliver up a baby delivered via surrogacy.

  20. Very interesting story but I don't think it happened. Fiction. Why?
    1. A man who can comfortably sleep with a married woman can also sleep with a single lady. What stopped him from impregnating a single lady instead?
    2. I believe DNA can be done at any age. Even on a new born. There was no reason to wait until the baby has 'come of age'.

    Anyways, the child belongs to the woman too since her egg was used. Unless they had agreement that the woman was only 'donor' and would have nothing to do with the child afterwards.


    The only thing that possibly happened was that he wanted to take someone's wife for himself and was played. That was why he would move her to the main house.


    I am curious, Kunle. Perhaps lawyers were curious too and asked. How did he introduce her to his guests and other servants when she moved to the main house? Girlfriend? Wife? fiancee? Surrogate? πŸ€”πŸ€”πŸ˜‚πŸ˜‚πŸ˜‚

    1. No single element of this was made up, this I can tell you for free. The writer had to edit and leave out some portions for obvious reasons. Certain things must not be disclosed without the consent of the characters. The DNA could not be done because it happened at the peak of the lockdown in 2020. A pre-natal DNA can be conducted even and a DNA could be conducted immediately after birth but for a child to be ripe for a DNA in the circumstance, the necessary court papers must be sought and obtained which was impossible because the courts were not sitting at the time.

  21. Greed and wickedness. Your heartless friend wanted to obtain a poor man's wife and it backfired. If he needs children, he should go to the same care home and pick one or to the meet the many ladies looking to make their own babies outside wedlock and sleep with or maybe some of the slay girls he sleeps with since he is loose. Many comely single women are looking to conceive with men who can provide.

    With the way he has treated this couple, I hope the woman who condescended to sleep with him can see he is bad news: a vindictive and selfish man. He was hoping she'll get used to the soft life and abandon her husband and kids the same way he has abandoned his. I use the word abandon because even without custody, a man can still maintain access (visitation) and a strong relationship with his children. He just mentally detached from those children the moment he could no longer have their mother. No man who loves his children will want to have them or add to them in this dirty way. His only god is the one between his legs.
