In Nigeria there is always the Burden of Proof on the Victims and the culprits almost always walk free..Well i havent heard of anyone Jailed for Rape in Nigeria.

Let's wait and see..The Law says that ''you are Innocent until proven guilty''.

DeleteThe law is pretty straight forward Stella. The plaintiff is left with the burden of proof, admissible evidences proving she was raped, and under what circumstances the rape took place. In this case the doctor's report will have to show proof of forceful penetration, bruises that can prove there was a struggle..etc.
DeleteIn reality.. it's her words against his. But he however under the law is also protected, and is allowed to prove his innocence if he pleads not guilty. Therefore we cannot categorically call him a rapist just yet, no matter the sentiments or how convincing she sounds. He on the other hand can claim it was consensual and he can twist the case against her by citing that there was no struggle, which allowed him the use of condom, and no screaming that could have attracted anyone around. And the prosecuting counsel can also counter that, and in turn give reasons why it was impossible for the victim to get help, based on the isolated state of the premises or whatever. And to further strengthen the prosecution, testimonies from other victims along this line would be a bonus to help sustain the rape charges.
So u see, it's going to be a back and forth thing because no one was actually present and we cannot presumably condemn the accused based on emotions or assumptions.
In other climes, interesting enough, even if he has been convicted of rape before, this particular case would still be tried by its merit and he would NOT be convicted based on his past rape offence. Tricky but eh. The law will have to take its course. Hopefully the victim will have enough evidence to nail him. Otherwise this man will be one of many others to walk free after the Hola Hola..sadly so.

Rape surpasses the use of force. Many lecturers are guilty of rape, even with the absence of use of force. Often times, they threaten & intimidate students just to have their sick ways with them.

ReplyDeleteUnfortunately, the Nigerian legal system as in most around the world places the burden of proof on the alleged rape victim and that burden has to be proved beyond reasonable doubt. That means the victim had to prove among other thing that 1. there was sexual intercourse.(there must be penetration) and 2. that it was against her will.
Proving 1 above might not present a problem but it is the second point(ie, that it was against her will) that might present a challenge in this case because the lecturer might claim that the sex was consensual and to prove this, might ask her during cross examination why she did not scream or whether there are any injuries on her to show that she struggled or bruises in her private part to indicate forceful penetration.
That is why it is always advisable that an alleged rape victim goes as soon as possible to the hospital to get tested for all of the above state because most of the evidence will be difficult to get after 24hours.
Despite the defenses available to the accused, if the alleged victim has a sound legal team, they should still know what to do to refute his defenses (No be me go teach them their work. lol)
Stella may I also suggest that you do a regular post maybe tagger "SCHOOL REPORTS" where students can anonymously report cases of of sexual assaults, cult harassment, examination malpractices and other vices like this going on in schools today. You will be surprised the number of female (and even sometimes male) students that face harassment from lecturers and have no one to turn to. It might interest you to know that many top government functionaries read this blog and this might be a medium to bring it to the attention of the relevant authorities. Just a suggestion.

As for the unilag case, the victims story does not add up to me,so the prosecution might have a difficult time proving their case. As for the Unical case, i dont know the facts so i cant give an opinion but the University Authority has taken the right step. Generally why we dont have so much convictions for rape in Nigeria is cos 1. Proving rape is not easy 2. The victims are afraid to speak up most times. 3.Parties often settle out of court sometimes, especially when the complainant is no more interested in the prosecution of the case.
