Supreme Court Gives Reasons It Dismissed Atiku's Suit Challenging Buhar's Victory At The 2019 Presidential Plls..

The Supreme Court has held that Alhaji Atiku Abubakar and his party, the Peoples Democratic Party (PDP) were not able to prove beyond all reasonable doubt that the Independent National Electoral Commission, INEC had a server and that it transmitted election results electronically.







The apex court stated this while giving its reasons for dismissing the appeal by the PDP and Atiku.


The court held that the PDP and Atiku were wrong to have relied on results to get from a website: www.factsdontlieng.co., whose owner they could not establish, to claim to have won the election.

Justice Inyang Okoro, the lead judge, said, “I agree entirely with the court below that the appellants failed to prove that INEC has the server from which they got their figures.

“As a result, all the results, calculations, and analysis based on the results claimed are of no moment.”


The court resolved issue 3 against the appellant.

The apex court also resolved issue 4 against irregularity and corrupt practices against the appellants.

The 5th issue was also resolved against the appellant, which relates to the admission of some documents tendered by the respondents to the petition before the lower court.

The Supreme Court proceeded to dismiss the appeal after resolving all the five issues determined against the appellants.

    1. Forget who gave the judge his job. If you followed the case, Atiku had no case. He was deceived about the server nonsense.

      He might have won but he couldn't prove it.

  2. With this judgement, the Supreme court just affirmed that an affidavit can legally replace a certificate..

    You don't need to go to school anymore. Just swear an affidavit and you're ok.

    Atiku said he won based on server results purportedly owned by INEC. The INEC denied ownership and the Electoral laws doesn't recognize transmission of election results to any server.

    Atiku said Buhari is not qualified to contest because of certificate. Buhari tendered affidavit but Atiku didn't file counter affidavit. You can't just argue with a valid document except you file a counter. Affidavit is recognized by law but sentimental arguments are not.

    According to the law, to prove your case in such a matter, you must prove polling unit by polling unit. So out of over 1k polling units during the presidential election, Atiku called only 5 polling unit agents as witness. Atiku did not satisfy the requirements of the law.

    Now tell me, how can he win?
