Nigerian Govt Says Amotekun Is Not Backed By Law And Declares It Ilegal

The Federal Government has declared the security outfit by South-West states known as Operation Amotekun as illegal




In a statement signed by the Special Assistant on Media and Public Relations to the Attorney General of the Federation and Minister of Justice, Dr Umar Gwandu, the government said the establishment of Amotekun is not backed by any known law in the land.

The statement reads in part: “The setting up of the paramilitary organization called “Amotekun” is illegal and runs contrary to the provisions of the Nigerian law.


“The Constitution of the Federal Republic of Nigeria 1999 (as amended) has established the Army, Navy and Airforce, including the Police and other numerous paramilitary organisations for the purpose of the defence of Nigeria.

“As a consequence of this, no State Government, whether singly or in a group has the legal right and competence to establish any form of organization or agency for the defence of Nigeria or any of its constituent parts.

“This is sanctioned by the provision of Item 45 of the Second Schedule of the constitution of the Federal Republic of Nigeria (as amended) authorizing the Police and other Federal Government security services established by law to maintain law and order.


“The law will take its natural course in relation to excesses associated with organization, administration and participation in “Amotekun” or continuous association with it as an association.

“Finally, it is important to put on record that the Office of the Attorney General and Minister of Justice was not consulted on the matter.

“If it had, proper information and guidance would have been offered to ensure that Nigeria’s defence and corporate entity are preserved at all times.”

  2. Meanwhile, Sharia and Hisbah are legal in some northern states. Curse to all unity beggars. Buhari is just out to destroy whatever that's left of the geographical mistake called Nigeria.

    1. Gbam! I was about typing this when I saw your comment. Wasn't it in this country that we read policeman was arrested by hisbah. The attorney general closed his mouth, ears and eyes when it happened.

      Well, it could be he was not aware when it happened just like his principal.... Mschew.

    2. Is Hisbah a security outfit? Is that what it is in the State constitution? Do they carry guns? Are the units to regulate morality (through their own ways)? People are just drawing nexus where there isn’t. It is like equating wrestling and boxing. Yes, the two involve physical strength but different rules. Hisbah is not a police or security unit o. Learn before you comment.

    The armed, violent and maurading Fulani Herdsmen (Miyetti Allah) in the North is legal.
    Amotekun in the South West is illegal.
    IPOB an unarmed group in the South East is a Terrorist organization.
    I laugh in Swahili.

  6. The South West should stand up to this and not be jittery or cowed to surrender.
    This Amotekun has been sending jitters and restlessness in the bones of the Northerners bcoz they know their People hand no pure.
    Other Southern Geos shld follow suit. We need more of Amotekkun & Hisbah in other zones.
    I knew this yeye govt will come up with this when I read IBB condemned it.
