Lady Seeks Restraining Oder As IG Of Police Orders DNA On Her 9 Year Old Son After Family Of Late Hubby Hint At Foul Play..

The Inspector-General of Police, Mohammed Adamu, has ordered that a DNA test be conducted on nine-year-old Chidera Ekwerekwu following a protracted battle between the family of a late businessman, Victor Ekwerekwu, and his widow, Ndidiamaka Ekwerekwu, over the paternity of the child.

.
But the widow has gone to Justice D.A. Onyefulu of the Anambra State High Court for an order restraining the IG from releasing the result of the test conducted on the child.
.
According to her, subjecting the child to a DNA test “amounts to slavery, servitude and a degrading treatment, which is a gross violation of his fundamental rights as enshrined in Section 34 of the 1999 Constitution of the Federal Republic of Nigeria, as amended.”
.
While asking the court to declare any result arising from the DNA test a nullity, Mrs Ekwerekwu, in the suit filed by her lawyer, C.C. Obikwelu of Chidiobieze Chambers in Onitsha, prayed that she be paid N6bn as damages by both the police and her deceased husband’s family.
.
Among other reliefs, the plaintiff demanded “an order nullifying the result obtained from a purported DNA test conducted on the applicants forcibly without her consent and rendering such results null and void and not to be accepted by any court of law same being obtained by illegal and fraudulent means.”
.
Named as the first to sixth respondents were Charles Ekwerekwu, Njideka Ndiwe, Nonso Okechukwu, IG Mohammed Adamu, Abba Kyari (Deputy Commissioner of Police and Head of Intelligence Response Team) and CP of Anambra State.
.
PUNCH Metro had reported that the remains of Victor, who died on October 29, 2019, had been in a mortuary following a 10-month battle over the paternity of the boy, as well as the cause of his death.
.
A petition to the IG, dated January 3, 2020, by his family, said Ndidiamaka brought the child a few hours after Victor’s death and claimed that the deceased was responsible for the child.
.
The family, in the petition, said they suspected foul play given that the couple never had any child in their 18 years of marriage.

She should allow the DNA if her hands are clean so as to get this over with BUT if she does not come to equity with clean hands,It is understandable

    3. Shr refused because the late husbands family will altered the result because of their wealthy status. Just because they want properties to themselves they decided to go through the route of dna to carry out their evil ways. I’m so appalled that you guys don’t reason out of box and just base your comments on stella’s Red pen.

Why should she subject herself or her child to such? The only human she owes any explanation is dead. Any other person is infringing on personal rights and personal space. Such nonsense, and Stella dey talk clean hands, this is not a case of clean hands, this is a case of mind ya biz and kindly stay in your lane, extended family.

    1. Madam did you read till the end?

The couple were said to be childless for 18years. Obviously the woman was about to be kicked out as soon as her husband died and she quickly ran to buy/adopt a child. The family being hell-bent on taking all the wealth of their late brother, demanded a DNA as if it matters in Igbo tradition.

My aunt went through this. 10years of suffering with her husband but they were childless. Her husband died and the Catholic adoption process that have been slow to answer them came through for her when she cried to them that she was about to be kicked out empty handed by her late husband's family. They gave her a son that is 21years now and the Igwe of Umuoji stepped into the matter and it was settled that she and her son and any other child she wished to adopt in the future will be her late husband's, bear his name and keep his fortune.

      DON'T BE QUICK TO CONDEM.

Now the question is, did the deceased adopt the child before his death or the widow is doing this because of Inheritance? Very funny story.

    2. Of what use is their education and calibre of they are wicked enough to want to throw her out because they didn't have a child? For all you know, the man may have been the infertile one. Why should the woman provide a child to inherit her husband's assets? Should it not come to her by default? If the same fat3 befell one of their daughters, will they not fight for her to get what her husband left behind? This evil mentality of mistreating widows should be eradicated.

    3. @ 16.48, It is the deceased's fault. He should have willed his properties to his wife. He gave them the opportunity to mistreat her by not doing the needful.

That was how they almost killed my sister after suffering for eight years the husband died without having a child. She had to use her legs to run years later she is still suffering one sickness or the other coupled with frustrations.

Everyone should learn from this if you are buying properties write your names fully kemi and kehinde Adebayo. Just to avoid stories that touch. This is not fare.

The child might not have the man's DNA for real but the family just wants the woman to leave the marriage empty.

  14. Does a wife of 18 YEARS need to have a child with her husband to inherit his estate upon his demise if he died of natural causes?

In 18 years, did she not work or contribute positively in building the late husband's life and wealth?

The best they can do in this case is to split the deceased man's estate equally between his widow and his family/siblings.

My submission is based on the fact that his widow has rights having been married to him albeit without a child while his surving parents/siblings contributed to his life and success before his marriage.

It's unfortunate the man died without a Will.

    Please, stop the greed.
See how the man died without taking any of his earthly possessions to his grave.💁‍♀️

Imagine a younger brother burying a senior brother then forced me to pay him more than he spent on the burial, blood brothers o same mum and dad. I gave him quietly thinking it'll end there but no. They are trying to share what's left with all of them totalling six in number, 4 elderly women with grown up kids living in their various husband houses. I mean grandmas. Writing a will means they are protected. Make sure they know where all properties are and where all docs are kept even monies in the bank, tell your wife!

If she happens to be their sister how will they feel this is happening to her? With this kind of family the dead man MIGHT be the one with fertility issues else he would have impregnated someone else since! If the family is good to the wife she won't think of bringing in a child to claim properties. People should always think of their future before they take some steps
