PEPT Tribunal AffirmsTinubu lawfully Elected And Dismisses Atiku, Obi, APM’s Petitions

On Wednesday September 6, 2023, the Presidential Election Petition Tribunal affirmed Bola Ahmed Tinubu as the lawful winner of the 2023 presidential election.
This came after almost 12 hours of judgement delivery in three separate petitions against the conduct of the 2023 presidential election.


In the final decision of the Tribunal announced by Justice Haruna Simon Tsammani, the three petitions were found to be devoid of merit and were subsequently thrown out.

In the unanimous judgement of the five-man panel of Justices, the petitions of the Peoples Democratic Party, PDP, presidential candidate, Abubakar Atiku and that of the Labour Party, Peter Obi were found to have been predicated on hearsay that cannot be attached with any probate value.

All the four issues formulated in Atiku’s petition were resolved against him on the ground that he failed to adduce cogent and verifiable evidence to establish several allegations against Tinubu and the Independent National Electoral Commission, INEC.

Justice Tsammani, who read the final decisions, said that the final forfeiture of $460, 000 by Tinubu in 1993 was not in consonance with the provisions of the Nigerian laws.

The Justices held that for the forfeiture to be used as punishment in Nigeria, there must be arraignment, plea taken, full trial, conviction and outright sentence.

They dismissed the allegations of non-compliance with the Electoral Act against INEC by Atiku on the uploading of election results, adding that the law recognized only manual collation of results.
In the same vein, Obi’s claim of securing majority of lawful votes was rejected on the ground that it was not backed up with any credible evidence.

“The two petitioners failed to establish how non use of BVAS machine substantially affected the election,” it held.
The Justices accused Obi and Atiku of using social media to harass and blackmail the Tribunal rather than cogent and verifiable evidence of facts.

  5. what we should feel is not anger but pity. I hope the next generation of lawyers chose to do better and uphold the profession above anything else. because the judge I saw reading that pronouncement yesterday, something must be really wrong with his intellect

    1. Are you aware that they spent more than 10hours yesterday sitting down , you think it's easy to sit in a particular spot for so long without sleeping?
      These lawyers spent nights going through different old cases just to be able to present their case in Court, now that their work ended, allow them to get their deserved rest.
      Some of una just 1hr into church service, una don sleep off or start dey press phone out of boredomπŸ™„πŸ™„πŸ™„

  9. The judgment has been delivered and any of the aggrieved parties have a right to go to court.
    May Nigeria make progress, that is my earnest prayer.
    My counsel to young people however is not to let political activism consume them; the candidates of the various political parties did not join politics until after varying levels of successful careers, Atiku in the department of Customs, Tinubu and Obi in the corporate world.
    Fight for Nigeria or your political party but your future should be most important.

    Celebrating. Sincerely, you should be ashamed of yourself. You have a gangster president that can bully, pay off or kill off anybody that stands in his way and because he is from your geographical location, your brain cells feel it’s okay. Shame on your generation.

      My sister, all Nigerian politicians are thesame, they just have different names. Know that and know peace. If they were any different, we would see it in their works. Adamawa would have been more developed than it is now same with Anambra. Lagos would be competing wt major European cities by now if the politicians were any better. So pls chill and don’t let Nigerian politics make u mk enemies or give u HBP.

    4. Stop lying to yourself. Constitution was trampled upon. It isn’t about BAT touching them. It’s good and evil. Is he supposed to be the president? No way. Even if he becomes the best president, it does not change the injustice and wrong. Double citizenship, technicality. 25% FCT is like every other state. Why does FCT have a Minister not a governor. Any aspect of the constitution can be destroyed. We do not have a law. Nigeria is now a jungle. Welcome. Ps I am from the middle belt not South East.

    It was the courts job to ask inec to produce evidence
