Court Rules That CBN Directive Demanding Customers Social Media Handle Is Valid

A recent court case against the Central Bank of Nigeria ended with the Judge ruling that banks can demand customers’ social media handles as part of their Know-Your-Customer (KYC) requirement.

The CBN had issued a directive in June 2023 requiring banks to collect and verify social media handles to prevent financial crime, terrorism, and to boost the precision and thoroughness of customer identification however Chris Eke,a customer represented by lawyer Olubunmi Abayomi-Olukunle, had filed a suit arguing that the CBN’s directive infringed upon constitutional rights, particularly section 37 of the 1999 constitution.

The presiding judge, Nnamdi Dimgba, struck out the suit, ruling that providing a social media handle is equivalent to providing email and phone numbers for potential customers, and therefore, it does not violate the right to privacy. The judge also noted that the regulations apply to financial institutions and not to private individuals. He further stated that if a customer is irritated by the requirement of the regulation, they have a choice to refuse to do business with any bank insisting on the information as part of its social media handle, and to seek other alternatives.

  3. How can the judge say that a social media handle is the same as email and phone number?
As of today, a Bank customer is supposed to provide his personal details, email, phone number, address, local govt of origin, Next of Kin details, Valid passport, BVN, NIN etc.

All these for the bank to end up debiting the customer indiscriminately in the form of hidden charges. To make matters worse, you can't even go over the counter and withdraw N50k from most banks. ATMs are not dispensing and you will have to end up buying cash.

Requesting for social media handles is just adding insult to injury. Sooner or later, people will close their accounts and go back to traditional ways of saving money.
