Nigerian Lawyers Give President Buhari 7 Days To Reverse Suspension On Suspended CJN Onnoghen

Nigerian lawyers under the aegis of Coalition Of Lawyers Against Corruption in Nigeria, COLAC, has given President Muhammadu Buhari seven days to reinstate the Chief Justice of Nigeria, CJN, Walter Onnoghen.





The CJN was suspended yesterday by President Buhari who said that he acted on an order by the Code of Conduct Tribunal, CCT.

COLAC said by this singular act, President Buhari has demonstrated that he does not have any regard for the Supreme law of the land which is the constitution.


In a statement to DAILY POST by Barrister Olusegun Bamgbose, National Coordinator, COLAC, the lawyers said the President should be reminded that his lack of respect for the rule of law was capable of truncating our nascent democracy.

The statement added, “The purported suspension of Onnoghen as the Chief Justice of Nigeria by President Buhari, is undoubtedly unconstitutional and unacceptable. It’s a complete show of shame.

“The reason given by the President that he was ordered by the CCT to wield the big stick is legally and morally watery. It’s unreasonable and illogical.


“It has become very obvious that the President does not have any iota for the Supreme law of the land which is our Constitution.

“The President has resulted to self-help in dispensing justice. The President should, however, be reminded that his lack of respect for the rule of law is capable of truncating our nascent democracy.

“Judiciary is a noble institution and we will never for any reason permit anyone to desecrate and decimate it. The Constitution must be respected at all times.

“The President has really crossed his boundaries and must be brought to order. His action as President will certainly overheat the polity.

“We as Lawyers will not allow him to have his way this time around. We are giving him 7 days to rescind the decision or we shall do the needful.

“Other things being equal, Nigeria will be clocking 20 years of practising democracy in Nigeria and any attempt to subvert democracy will be totally resisted.

“We strongly urge the National Assembly to timely caution the President because illegality begets illegality. The time to say no to Mr. President is now.”

  3. Jonathan suspended Sanusi and also suspended Justice Salami, where was the outcry then. For goodness sakes this guy Onnoghen admitted to the crime he is being accused of but his defence was that he forgot. Ignorance is not an excuse in the eyes of the law.

    3. Jonathan didn't suspend justice salami. Check your facts well. It was the National Judicial Council that pursued his matter. And even then, the opposition did cry out louuuuddd! This act of the president is executive lawlessness at its most arrogant. There are constitutionally prescribed steps for handling a Judicial officer. The president cant wake up one day and 'suspend" the Chief Justice. Constitutionally, he cant do that. Besides, I thought he was supposed to be the 'not corrupt' one? Why are you comparing him to Jonathan then?

    4. Yes ignorance is not an excuse in law. But if this administration is following the law, then by all means they should follow it well. We are not in a military dictatorship. The power to suspend the chief justice does not lie with the president. There are steps spelt out clearly in the law and in the constitution for handling the chief justice.

    5. Teejay is quick to counter anonymous on Justice Salami but kept quiet on Sanusi because he has no defence. Hypocrite! Did GEJ wait for Senate two third before he removed Sanusi? Even though Sanusi committed no crime. Onnoghen is a thief, criminal and should face his punishment. He cannot be the head of NJC and want the case to be taken to NJC for recommendation. That is conflict of interest.

    6. Yes the NJC suspended Justice Salami. but when deciding the case between Justices Salami and the then CJN, the CJN as Head of that Council excused himself. Our current CJN is going for exparte motions to stop anyone from probing him. Why? Moreover, the case was decided in justice salamis favour and the president was asked to re-instate him. Jonathan and his party PDP never heeded this directive until an upright old mans career ended in pain and disgrace. this is dejavu. May they not survive it. Buhari..go on jare. Let them cry themselves hoarse. And the bunch of joker and lawless corrupt lawyers with a president who is also in court on charges of corruption, what do you expect from them?

  6. NBA also gave out their own ultimatum. In all of these, one thing I found out is that, none is exonerating the CJN but all faulting the act of the 'President'. Whoever advice this act being carried out never have the good interest of this country at heart. CCT was pressured by the presidency to issue an ex-parte shortly a day after an appeal court has already ruled the motion that trial should stop at the moment. The government result to self-help in their own case before a court. Let's see what happens with this ultimatum given.

  14. You can not SUSPEND a CJN. Just like you cannot suspend a governor or a president. The CJN should carry on and disregard the purported suspension. Similarly, the Body of Benchers should suspend Tanko for conniving to unseat a CJN and going ahead with the purported swearing in despite a court injunction. Not to mention that the entire judicial system should shut down immediately. Not one single court should open by Monday. Ministries of justice shit down. Every single one. This is dictator at its height And cannot be allowed to stand, no matter what.

    This is me talking jurisprudential-ly otherwise we set a precedent that will beleaguer the legal profession forever.

  18. ...and less than 24 hours after the 'acting" chief justice was sworn in, he has quickly inaugurated election tribunals. This is what it has been about all along. Anyone who thinks this is about the former Chief Jistice"s 'corruption' is as naive as they come. A party that has Amaechi, Oshiomole, Akpabio and co as chieftains and leaders cannot with a straight face refer to the previous administration as corrupt. Once APC throws the word "corruption' out there, gullible Nigerians start typing unintelligent arguments on social media without digging a bit deeper. As if anyone in this present administration is not corrupt.
