Police Confirm Actor Accused Of Defiling A Minor Has Been Released On Bail Because Case Is Now Statute Barred

A senior officer at the Lagos State Police Command has confirmed to PUNCH Metro that a directive had been given for the release of Nollywood actor, Olanrewaju Omiyinka, aka Baba Ijesha, from custody.







The source said due to the ongoing strike by members of the Judicial Staff Union of Nigeria, courts had ceased from sitting and the suspect could not be detained indefinitely without trial.


The source, however, said investigation into the recent allegation against Omiyinka revealed that he did not defile the victim, adding that when she was questioned, the victim confirmed the same.


The senior police officer stated, “There was no case of defilement, people are just talking out of sentiment. They are not talking from the point of law. We interviewed all parties involved in the case for three hours today (Wednesday).


“The mother complained that her child was at the age of seven when she was defiled and the child pointed at Baba Ijesha. But the case was not reported until she was 14 years and under the law, the case has become statute-barred.


“Regarding this new case, the CCTV footage has been assessed and nowhere was it captured that Baba Ijesha defiled her. The footage only showed him touching the victim’s body but it never showed him having any sexual intercourse with the girl. The girl also confirmed the same thing.


“So, in law, it is a case of indecent assault and not sexual harassment, and it is open to bail. So, can we continue to keep him when the offence is subject to bail and when there is no court sitting? That is against his fundamental human rights and the police do not work on sentiments. Directives have been given out for his release on bail.”


The source, however, said that despite granting Omiyinka bail, investigation would continue, adding that the command had also sought legal opinion from the state Ministry of Justice.


The source added, “A test was recently done on the victim and it was discovered that she had penetration. Is it the penetration of seven years that is still evident now, and who penetrated her then? Is there any medical report linking the man (Omiyinka) to the crime?


“The CCTV footage never showed Baba Ijesha defiling her, but he confessed to touching her body indecently and apologised, and the girl confirmed the same.
Investigation is still ongoing and we have instructed them to conduct a medical examination on the victim at a government recognised medical facility. We are not specialists in the field and we have also sought legal opinion from the Ministry of Justice.”

    9. The correctness of the police officer’s statement on statute bar will depend on whether the accusations was on defilement or indecent treatment.

      Prosecution for defilement (rape of women under 13 or 16 depending on the circumstances) must be within 2 months from when the incident happened... on the contrary, there is no such statute bar provision for indecent treatment of girls under 16 (fondling, sexual handling etc fall under this category).

      So the officer will only be correct per statute bar if Baba Ijesha was accused of defilement.

    The law and indeed logic does not look at situation based on your own experience. It looks at the facts of it.

    Touching a child (not the actual fingering or rubbing body) on their body innocently is not a criminal offence.

    There are many people that play innocently with children without realising that what they are doing could be 'viewed' by mentally damaged women as indecent assault and child molestation.


    As a man who was sexually molested at age 7 and 10 by four women...I did not go about thinking every lady that touch/hug my son or kiss my child on the cheek as a form of genuine affection for a child is sexually molesting him.

    Women see things and act emotionally...and if it were to be the other way round would term it as child molestation.

Innocent people have been convicted, and even executed in developed countries like the U.S. Criminals have gone scot-free, even after intense trial. People have spent decades in jail, due only to false witness testimony. Some regained their freedom, after re-trials that found them innocent. But, who can restore the years and decades they wasted in jail? I hate to think about it. Only God can truly judge. It's well.

  30. If there is video evidence of him touching a 14 year old girl sexually, and he confessed to the act, then he should be prosecuted for sexual molestation of a minor (she is not up to the age of sexual consent)

    As for the case of 7years ago
    What if he killed someone 7years ago, and new evidence came out and exposed him, will the case be statute barred too??
