DeleteWell, her issue is a peculiar one. In that her action was a premeditated self defence, at the time she 'killed' no abuse was taking place. However the burden of proof is upon her attorney, who has to explain to the court that in actual fact her being married at her age was life threatening, or otherwise an abusive one of any kind.
DeleteAnd we all know that in the confines of the jurisdiction where she resides, being the north where the event took place, she was 'lawfully' wedded as it were. And of course she hadn't before the crime took place recorded any 'rape' or threats to her life by her husband.
As sick and pathetic as it sounds the law will take its course without sentiments and without regards to her age as a juvenile. The admissible evidence is the poison she used and the circumstances in which it was administered...which is why it is a premeditated offence.
Therefore it is unlikely that the court will extend her the much needed pardon vis-a-vis self defence given the scenario.
Simply pit she committed murder in the first degree. If he died by happenstance, perhaps while there was a struggle and she stabbed him, then she would walk free. Sad but that's the law.

However in practice it's quite unfortunate that children are usually tried as adults on criminal offences. She ought to be tried as a juvenile according to what our law provides. Unfortunately practice and theory are world's apart in our legal system.

A lot of things will play against the poor little girl,she is being tried in a high court in the north where the child bride act is being proudly practiced. I believe a good representation should be able to get her off on manslaughter. It's just soo sad. Our legal system has too many loop holes.

If not treated well, others will follow suit to kill in claim of being minor also..... Ignorance is never an excuse in law, so i may just have to plead on her behalf that the court tempers justice with mercy by sparing her such death penalty...but that doesn't mean she won't be punished severely if really "she is guilty as charged".
