OAP Toke Makinwa Reportedly Faces N50bn Lawsuit As 48 Hours Ultimatum To Retract Alleged Defamation Of Billionaire Expires

On-Air Personality, Toke Makinwa, was given a 48-hour ultimatum to retract an allegation made against an Abuja-based businessman, Alhaji Abubakar Aliyu, or risk a N50 billion naira defamation lawsuit....

The Ultimatum expires today and there has been no retraction or apology.

The allegation published against the business man claimed Toke Makinwa was in a relationship with him and that he had made promises to her which were not fulfilled.

It was widely reported that Toke had slammed a lawsuit against the supposed lover following the unfulfilled promises but in a swift reaction to the rumours, Alhaji Aliyu expressed surprises at the allegation making the rounds on social media platforms, saying he has never met Makinwa in his life and wondered why she would make such spurious and malicious allegations against him.

A press statement by Media Aide, Kadiri Joseph, quoted Alhaji Aliyu as saying he is a responsible married man with children and will never stoop so low to such an act.

He described the allegation as a cheap blackmail by his detractors to ridicule him and bring him to disrepute.

Alhaji Aliyu is, therefore, demanding that Toke Makinwa retracts the allegation and tenders an unreserved apology that must be published in at least seven national dailies and in all the online platform where the allegation were originally published.

He is also demanding that all the online platforms pull down the false publication and apologise for not verifying the story before going to press as responsible journalism demands.

He said failure to do this within the next 48 hours, he would have no option but to approach a court of competent jurisdiction for redress.

Alhaji Aliyu said ” I do not know this girl in question, my detractors are at work. How? When? This is pure defamation, she must retract this false allegation”.
I have spoken to my lawyers to take appropriate action.”

No b Alhaji AA Oil again, that marries & divorces every year & doesn’t live with any of his wives, rather , he hibernates in guest houses with more women & has no regards for them. Money miss road. 29. God’s masterpiece, so u believe that Toke would want to marry a man with wives & from another religion? All these ladies want their money only. Ds man is illiterate, from Kogi, but highly connected & rich , with over four wives & concubines littered all over Abj. Very razz , short man. If there’s really any thing between them, Toke wants just his money. Marriage kor.

It is left to the courts to decide whether western laws are permissible in Nigeria.

  32. I sincerely don't believe this gist...toke just want to trend this new year.beside you can't sue someone because of unfulfilled promises that is not documented, and shame will'nt let toke to bring out her source of income in the public.my opinion tho...

  34. PROOF OF BREACH OF PROMISE TO MARRY:
In order to succeed in an action for breach of promise to marry, the Claimant (the jilted party) has to prove two elements:

The party jilted must prove to the satisfaction of the court that there was in fact a promise of marriage under the Matrimonial Causes Act, 1990, or under Islamic Law or under Customary Law, on the part of the other sex.
The party reneging has really, and as a matter of fact, failed or refused to keep to the agreement of marriage. See EZEANAH V. ATTA (supra).
In order to satisfy the court that there was a binding promise of marriage, the jilted party has to show that consideration was furnished to support the promise and may need to corroborate facts by calling a witness or witnesses as the case may be.
