Ikpeazu Insists He is Still Governor And Obtains Court Injunction Restraining Ogah From Being Sworn In

Today,INEC issued Dr. Uche Ogah a Certificate of Return by the Independent National Electoral Commission (INEC) but the state governor, Okezie Ikpeazu released a statement insisting that he remains the governor pending the resolution of his appeal against the ruling by the appellant courts.




He also obtained an injunction from an Abia State High Court restraining the Chief Justice of the state from swearing in Ogah as governor.

''I have received with concern, report of the purported issuance of Certificate of Return to Mr. Uche Ogah by the Independent National Electoral Commission (INEC), as governor of Abia State, despite dependency of a notice of appeal and motion for stay of the orders made by Justice Okon Abang of the Federal High Court, Abuja.
Our laws are clear on this matter. No one may be issued with a certificate of return let alone be sworn in as governor, when there is a subsisting appeal and application for stay.
I want to appeal to Abians to remain calm and law abiding in the face of this provocation, unless and until the appellant courts have conclusively resolved the appeal, the status remains, I am still the Governor of Abia State.

Stella pls don't support him..in be half of abians. .we are super excited..lol..to cut the long story short.how can a sitting governor not get competent lawyers to see him through a serious case like this?..and then he is getting injunction from a lower court *..am too tired to write the legal implications of this case.let me go to bed.surely ogah will be sworn in tmwr and even the supreme court will uphold the judgement of the federal high court on appeal..until the constitution,electoral laws and party laws are properly amended we have not seen the last of this cases.

    2. Sassychick,don't mind ikepazu. How do one get an injunction from a lower court restraining a higher court order. Even common sense could have told him otherwise,his lawyer will just be taking money n wasting his time.He should have gone for stay of execution from the federal high court or the appeal court if F.H.C refused to grant him the order.

    4. What lower court? The federal, state and industrial court are of concurrent jurisdiction. Meanwhile the exparte order obtained is a different kettle of fish with the judgment of the federal high court. Please let's be guided by the law in our comments

  6. I was really surprised today when I heard a cert of return was issued, like does he not have a right of appeal? Why are we so lawless in this country? The INEC official said he was obeying the federal high court order which said a cert of return be issued to the petitioner, but is this so called INEC official not aware of Ikpeazu's appeal? Why must these people heat up the polity every time? Must we always have drama to watch? Do they derive satisfaction from giving us something to talk about? It is well.

    1. He has right of appeal but the person whom the judgment was in his favour will not sit n wait for him to appeal,its his duty to quickly go for his appeal before execution of the order of the court.

  7. in as much i dont have any love or likeness for Okezie and that i believe that ogah will do much more better i think and believe that the way the court and INEC have handled the issue is very wrong. they are setting bad precedence in this country

  18. Stella, please I would appreciate it if you can do some research before saying a needless prayer for the ousted Governor, Ikpeazu. He stole the mandate from Otti and maneuvered his way into Abia Govt House. We Abians detest all he stands for especially for being T. A. Orji's stooge. Enough is enough!!! He should vacate that seat or else???
