Couch Convo - The Marriage Certificate.

This post is about the Marriage certificate and who gets to keep it forever between the husband and the wife.....

Are there Lawyers in the house or anyone who understand court Marriage and its concept?

Why is the woman told to guide and guard the Marriage certificate with her life after a court wedding?

What are the advantages and disadvantages of both parties keeping the certificate?

Is there any risk for the wife if she allows her husband keep the marriage certificate?

  5. It doesn't matter who keeps it the original. You can always get a certified true copy from the marriage registry or church where the marriage was celebrated.

  7. Well , I don’t know really so I’ll sit this one one out a bit .

When our marriage certificate came back in the 📫 after getting it signed by the judge etc . My husband had it with him then gave it to me for keeps ..plus I get to use it to apply for certain things etc . Personally I feel anyone can keep the certificate doesn’t matter .

  8. It doesn't mean anything.. just people being cultural because society believes that it is the woman's job to keep the marriage. It doesn't matter who keeps it. But it is an important document to have for the times of travelling, jobs and even death of a spouse as per will. So dear women if you haven't done court and you're forming married. you better pressure bobo and get it down o.

  9. I just think it’s tradition to give the marriage certificate to the woman but both husband and wife are entitled to a copy so it’s best to give it to a solicitor.

  10. In Nigeria, I guess its given to the woman to protect the rights of women in marriage. With the certificate, should anything happen to the man, the woman wouldn't have to start battling with relatives for property.

  11. I guess it stems from the fact that the woman may be at the receiving end if the marriage crashes...

  12. Our marriage certificate is with my husband. He is more organized and knows how to keep those type of things. Ask about it in months to come and it will still be looking brand new. So he kept it. And it's safe. It doesn't matter who keeps it. So far married dey intact lol

  14. Stella, the wife keeping the marriage certificate stems from the history of when men go to war and leave a prized possession for the wife to be able to take care of the family in case he doesn't return. The marriage certificate is that prized possession that proves the woman is legally married to the wife and as such has some degree of possession in the man's name...it's something like that sha

    5. 22.05, some organizations reject laminated documents. Some embassies as well state it that don't submit laminated docs. Maybe they want to really ascertain the originality 🤷🤷

  17. Well the marriage working or not lies in the hands of woman, she is a better Keeper than the man and also it helps her prove her marriage if the man decide to misbehave 🦋

  20. Either the wife or husband can keep the certificate. However, "SOME" men tend to give their wives to keep because they believe women are more organized and have good memories of things/events.

On the other hand, the certificate symbolizes they are legally married under the law and either of the parties can go to court when issues arises.

It doesn't favor any one precisely, it only does when either the husband or wife has a good cause of action.

There is no risk if either the husband or wife keeps it, if issues should arise that requires going to court and you need the certificate and your spouse is denying you a copy, you can apply for a certified true copy of the certificate.

    1. In addition, marriage under the law (statutory marriage - is a union of one man and one woman to the exclusion of others)

Hence, the man cannot marry another woman also the woman cannot marry another man EXCEPT they divorce in a competent court, then they can move on to whoever they choose.

    2. Just that getting certified true copies (CTC) of documents in Nigeria can be very very difficult and costly at times, if not most times. And the older the document, the more difficult and costly a CTC of it.

Generally, the belief is that registry marriage enhances a woman's right to matrimonial property on divorce or death of the husband. So, the registry staff who are mostly women, hand it to the woman to ease proof of the marriage if needed.

Times are, however, changing. Some women have as much as or even more than their husbands before marriage, and some wives are the major sources of the matrimonial property during marriage. So who collects and keep the certificate depends on factors other than marital rights and inheritance.

Some men do not care over who keeps the certificate. What some women do is that they collect it from the registry staff, and hand it over to their husbands. What happens after should be decided in love.

When a marriage is working, who keeps the certificate should be determined by who is more care/safety conscious and organised.

Marriage is an agreement. All agreements are kept and held together by the hearts of parties to the agreement, not by the agreement papers.

But any man or woman in a troubled marriage and foreseeing a contested divorce can make a photocopy. It is easier to get a CTC if you have a photocopy. And if a CTC is impossible to get, the photocopy can be ingeniously used to achieve same purpose as a CTC or the original.
