The order came on Thursday after his lawyer filed a fundamental rights case.
KC Luxury has spent more than 14 days in NDLEA custody without being formally charged or taken to court for arraignment.
Justice Friday Ogazi directed the agency to produce him on the next hearing date. The court also told NDLEA to respond within five days and explain why he should not be released or granted bail. The case was adjourned for further hearing to early September.
Earlier, on August, 20, 2026 another Federal High Court judge, Justice Akintayo Aluko had granted NDLEA a 30 day extension of his detention so the agency could continue its investigation. That order also froze certain bank accounts connected to him. The two court decisions have created some legal uncertainty around the detention.
KC Luxury’s legal team, led by Senior Advocate of Nigeria A. Labi-Lawal, argues that holding him beyond the allowed period without charge violates his rights. They have also raised medical concerns, saying he suffers from asthma that needs proper treatment.
The court order to produce him does not decide guilt or innocence. It simply requires NDLEA to bring him before the judge so the rights case can be properly heard. Further hearings will decide the next steps.
